Uptick in homicides and violent crime for San Jose

San Jose's homicide total for the year is the highest since 1991 and the pre-Three Strikes Law era. The latest victim was an 18 year old teenage boy. Called to the scene to investigate what appeared to be a car crash, police found the victim laying several feet away from the crashed vehicle. The injuries however were not from the accident, but rather a gunshot wound.

At present there are no suspects and no known motives for the shooting. San Jose's 44 homicides are on the heels of last year's total of 40 which doubled the 20-year achieved in 2010. While the ratio of population to homicide and violent crimes still remains quite high, especially when compared to some neighboring Californian metropolises, it still presents a large concern to the community.

Former fiancée arrested as accessory in beheading murder

Far south of San Jose, police have arrested a woman formerly engaged to an actor accused of beheading his neighbor. Officials accuse the woman of being an accessory to murder after the fact.

The former boyfriend faces a homicide charge in the killing two years ago in Costa Mesa.

California program reduces released inmates' arrest rate

A program developed by correctional officials and implemented in the last few years since 2007 appears to have reduced the rate at which parolees in California previously convicted of felonies are rearrested after their release.

Parolees from San Jose and throughout the state who are regarded as a high risk for committing additional offenses are being targeted by the program.

Two California men accused of stealing $10 million of art, bling

Thieves recently stole glittering, pricey items from a star California bond trader. They reportely made off with expensive watches, rare bottles of wine and a red 2010 Porsche Carrera 4S. They also made off with even more valuable paintings, including works by Piet Mondrian, Jasper Johns and Richard Diebenkorn.

Law enforcement recently arrested two men and charged them with theft of the items worth an estimated $10 million.

San Jose taggers labeled a street gang

A non-violent group of graffiti artists, or "taggers," have been charged by the Santa Clara County prosecutors as a criminal street gang, putting them in the same category as the notorious Bloods and Crips. Their weapons of choice aren't guns or knives, but rather spray paint used in elaborate graffiti across the Bay Area.

There are those who recognize that graffiti is a costly issue for communities, though the taggers themselves likely think that they are contributing to the culture of the area. This marks the first time that the gang enhancement has been used against a nonviolent group. The enhancement means that any sentences would be significantly longer as felonies: 5 to 22 years. Not to mention the "three strikes," which would lead to even more serious consequences.

Challenge to California's DNA collection law

The San Jose Mercury News recently reported on a legal challenge to California's DNA collection law. The law allows police agencies to collect DNA samples from anyone in the state accused of a felony.

As an illustration of how the law can be applied, the newspaper cited the case of a woman who was arrested in San Francisco three years ago during an anti-war demonstration and charged with a felony for allegedly trying to help a fellow protester escape police custody.

Awaiting fraud trial, San Jose woman arrested on new fraud charges

San Jose police officers said a woman suspected of fraud was wearing an electronic monitoring anklet when she tried to run from them last Friday at her home.

The woman, 53, was wearing the anklet as a condition of her release on bail as she awaited trial on previous fraud charges.

Sunnyvale school CEO charged with fraud

The CEO of a Silicon Valley school known for attracting foreign students, many from India, was recently arrested by federal agents and charged with visa fraud.

The head of Herguan University in Sunnyvale was arrested at his Santa Clara home and then charged in a 15-count indictment. If convicted on all charges, he faces up to 23 years in prison and fines of more than $1 million.

Police: Elderly San Jose man arrested for white collar crime

Investigators have ordered a California man to hand over his eye charts and close up shop. The owner and operator of a San Jose optical store is charged with a white collar crime that could send the 73-year-old to prison for over a decade.

The elderly optician is accused of conducting eye exams and dispensing prescriptions. Those are jobs that only licensed ophthalmologists and optometrists legally can perform. Opticians are like pharmacists; they can interpret and fill prescriptions but are not allowed to examine patients or prescribe eye treatments.

Sierra LaMar murder suspect's arraignment rescheduled again

He was arrested nearly two weeks ago, but the man police suspect of murdering 15-year-old Sierra LaMar has yet to enter a plea. The arraignment hearing for the Morgan Hill man, 21, was postponed again yesterday at the Santa Clara County Hall of Justice in San Jose and rescheduled for July 10.

The suspect is charged with homicide, with a special circumstance involving kidnapping.

Man charged with kidnapping, death of missing Morgan Hill teen

A 15-year-old Santa Clara County girl has been missing over two months. The last time the teenager was seen in her Morgan Hill neighborhood was before she left home to catch a bus for school.

The search for the high school girl has evolved into a homicide investigation. The county sheriff told reporters at a news conference that an arrest of a 21-year-old Morgan Hill man was made based on physical evidence. The official said she believes investigators have probable cause that the girl was killed and that the pair didn't know each other.

San Jose jury deadlocked in murder case

We wrote last week about an intriguing San Jose case in which a man was accused of homicide back in 2009. The alleged weapon? His Honda Civic.

On Tuesday, the jury in the case reported to the judge that it was divided after a day and a half of deliberations, unable to agree on a verdict.

San Jose man on trial for violent crime committed with car

A San Jose man has several charges, including a charge for a violent crime, pending against him in different cases. In one case, he is accused of purposely running over a woman with his car when he was 19 years old.

The man is now 23 years old. Witnesses at his trial testified that they warned him that his reckless driving was going to get someone hurt or killed.

California assemblyman arrested for drunk driving

Being pulled over for suspicion of drunk driving is bad, but when you are a local public figure, it can be a lot worse because the arrest is publicized through the media. Last week assemblyman Roger Hernandez of California, was arrested for suspicion of drunk driving after officers saw his car weaving between lanes.

The incident occurred in the early morning hours of Mar. 27 when a Concord police officer noticed a car drifting between lanes along Concord Avenue. The officer pulled over the car when Hernandez failed to signal his turn into a hotel parking lot. When the officer approached the car and spoke to Hernandez, he thought that his demeanor and speech reflected that he had been drinking. The officer also smelled alcohol from inside the car.

San Jose couple accused of robbery and carjacking

San Jose police arrested a 39-year-old man and a 28-year-old woman on March 17, accusing them of involvement in a robbery and carjacking. Officers asserted that the couple had taken a gold-colored Cadillac Escalade at approximately 9:50 p.m. on March 15.

They allegedly took the car from a Calco gas station at 6095 Cahalan Avenue.

San Jose teens arrested for armed robbery, assault

Last weekend, two teenagers conducted a series of armed robberies before crashing their car into a police cruiser and injuring an officer, San Jose law enforcement officials said.

An 18-year-old was arrested and being held at Santa Clara County Jail, while the other suspect, 13 years old, was held by the juvenile system for their juvenile criminal charges.

San Jose teens arrested for assaulting man, killing his dog

According to KTVU TV, San Jose police have taken into custody three teenagers suspected of beating a man and killing his dog in February.

The trio faces an array of criminal charges, including assault with a deadly weapon, robbery and a gang enhancement. They might also face animal cruelty charges, according to law enforcement officials.

Hell's Angel arrested in connection with funeral slaying

Police located and arrested a Hell's Angel member in Fremont recently in connection with an October homicide. The gang member is suspected of shooting a fellow member of the Hell's Angels during the funeral ceremony for the local chapter president.

This incident is the latest in what police describe as a "saga of violence" between gang groups in metropolitan areas of California. Rival groups Vagos and the Hell's Angels have been staging a street war, according to officials, which has resulted in the death and injury of several gang members.

San Jose courtroom to host trial that could fuse sex, drugs, politics

The case began on San Jose's Stevens Creek Boulevard last September. That's when police pulled over the driver of a 2003 Nissan 350Z and leveled drug charges against him.

But the case has turned into a full-blown scandal for California state Treasurer Bill Lockyer, 70, and his wife, Nadia, 40, an Alameda County supervisor who was reportedly having an affair with the 35-year-old man now free on $15,000 bail.

Two arrested on drug-making suspicions after explosion

As people in San Jose know, California drug laws provide for harsh punishments for offenders. When the charges involve drug manufacturing or drug trafficking, punishments escalate.

Two San Francisco people now face charges that they manufactured illegal drugs for purposes of selling them. The 26-year-old man and 33-year-old woman were arrested after an explosion tore through their apartment on Feb. 7.
